Terms & Conditions

These terms set out how bookings, galleries, print products, image usage, payments, and other services are handled by Juli Burns Photography.

Bookings & Session Management

Everything related to securing your date, cancellations, rescheduling, and how the session or event is handled.

1. Bookings & Deposits

  • A booking is only confirmed once the required deposit or full balance has been received.
  • Dates are not held or secured without payment of the deposit.
  • All deposits are non-refundable, as they secure your booking date and cover time and preparation associated with your session or event.
  • The remaining balance is due as outlined on your invoice and must be paid in full prior to the delivery of final images, unless otherwise agreed in writing.
  • In the event of a cancellation, the deposit will be forfeited.
  • Rescheduling may be offered at the photographer’s discretion and is subject to availability.

2. Cancellations & Reschedules

  • All cancellations must be provided in writing.
  • In the event of cancellation, all deposits are non-refundable.
  • Rescheduling requests must also be made in writing and are subject to availability.
  • A maximum of one reschedule is permitted per booking unless otherwise agreed.
  • Additional reschedules may incur a fee.
  • For weather-dependent shoots, including motocross events, the photographer reserves the right to determine whether conditions are suitable to proceed.
  • Where necessary, an alternative date or location may be offered.
  • If an event is cancelled by the organizer or venue, the booking may be rescheduled subject to availability.
  • If rescheduling is not possible, the deposit will be forfeited.

2.1 Photographer Cancellation

  • In the unlikely event that the photographer is unable to attend or complete the booking due to illness, emergency, equipment failure, or circumstances beyond control, all reasonable efforts will be made to reschedule the booking.
  • If rescheduling is not possible, a full refund of any payments made will be provided.
  • The photographer will not be held liable for any additional costs, losses, or damages incurred as a result of the cancellation.

3. Shoot Day

  • The client is responsible for obtaining any required permissions, passes, or credentials necessary for the photographer to access and perform at the agreed location or event.
  • Failure to secure appropriate access does not constitute a breach of contract by the photographer and does not entitle the client to a refund.
  • The photographer reserves the right to refuse, stop, or adjust coverage at any time where safety is a concern, conditions are unsuitable, or access is restricted by event officials or venue staff.
  • No guarantee is made regarding specific shots, angles, or coverage where access, safety, or environmental conditions are beyond the photographer’s control.

Galleries, Editing & Products

How proofs work, what editing is included, expected turnaround times, and how custom printed products are handled.

4. Proofs & Selection

  • Proof galleries are delivered digitally and contain watermarked images for selection purposes only.
  • Proof images must not be downloaded, shared, screenshot, or used in any form.
  • Watermarks are removed from all purchased downloads and printed products.
  • Proof galleries will remain available for a minimum of 30 days from the date of delivery.
  • After this period, galleries may be removed without notice.
  • The photographer is not responsible for maintaining or storing proof galleries beyond this timeframe.
  • Requests to restore expired galleries may incur an additional fee.

5. Editing & Turnaround

  • Standard editing includes color correction, exposure adjustments, and cropping in line with the photographer’s style.
  • Advanced retouching, including object removal, compositing, or extensive edits, is not included and will be quoted separately.
  • Turnaround times are typically 3–10 business days for action events.
  • Fine-art or custom projects may require additional time.
  • Delivery timeframes are estimates only and may vary depending on workload, event size, and peak periods.
  • The photographer retains full creative control over the editing style and final selection of delivered images.
  • Minor revision requests may be considered at the photographer’s discretion.
  • Additional editing or excessive revisions may incur an additional fee.
  • Expedited delivery may be available upon request and may incur a priority processing fee.

6. Prints, Posters & Calendars

  • We offer high-quality, museum-grade print options and ready-to-hang finishes.
  • Due to differences in screen calibration and printing processes, colors may vary slightly between digital previews and final printed products.
  • Such variations are not considered faults.
  • Custom sizes and paper stocks are available on request.
  • Calendars and posters are produced to order.
  • A digital proof will be provided for approval prior to printing.
  • It is the client’s responsibility to carefully review all details, including layout, text, and image selection.
  • Once approved, no further changes can be made.
  • As all printed products are custom-made, refunds or exchanges are not offered for change of mind or approved designs.
  • In the event of a manufacturing defect or damage, a replacement will be provided.
  • Production and delivery timeframes may vary depending on product type and supplier turnaround.

Image Usage & Credit

What clients can do with delivered images, what requires a separate licence, and how attribution should be handled.

7. Licensing & Usage

  • Unless otherwise agreed in writing, all images are licensed for personal use only.
  • This includes personal prints and sharing on personal social media accounts.
  • Where images are shared online, appropriate credit to Juli Burns Photography must be given where reasonably possible.
  • Images must not be altered, edited, or modified in any way without prior written permission from the photographer.
  • Commercial use, including but not limited to use by sponsors, brands, businesses, paid advertising, merchandise, or media outlets, requires a separate commercial licence and written approval.
  • Copyright of all images remains with Juli Burns Photography.
  • Unauthorized commercial use or misuse of images may result in additional licensing fees or legal action.

8. Attribution / Credit

  • When sharing images online, credit to Juli Burns Photography is required where reasonably possible.
  • This may include tagging @juliburnsphotography or clearly naming Juli Burns Photography in the caption.
  • Images must not be altered, edited, or have filters applied that change the appearance or integrity of the work without prior written permission.
  • Failure to provide appropriate credit or unauthorized alteration of images may be considered a breach of licensing terms.

Payments, Shipping & Customer Information

How payments are handled, how physical orders are shipped, and how personal information is used.

9. Payments & Refunds

  • Payments are processed via approved third-party providers (e.g. Stripe).
  • Full payment must be received in accordance with the terms outlined on the invoice.
  • Deposits are non-refundable.
  • Final balances must be paid in full prior to delivery of digital images or production of printed products, unless otherwise agreed in writing.
  • Digital downloads and custom print products are non-refundable once delivered or approved.
  • Refunds or replacements will only be provided where required under Australian Consumer Law.
  • The photographer reserves the right to withhold delivery of images or products until full payment has been received.
  • In the event of failed, declined, or disputed payments, the client remains responsible for all outstanding amounts.

10. Shipping & Delivery

  • Print orders are carefully packaged and shipped using reputable carriers.
  • Tracking will be provided where available.
  • Delivery timeframes are estimates only and may vary depending on location and carrier performance.
  • The photographer is not responsible for delays caused by shipping providers.
  • Risk of loss or damage transfers to the client once the order has been dispatched.
  • It is the client’s responsibility to ensure that all shipping details provided are accurate at the time of purchase.
  • In the event of lost or damaged items, the photographer will assist in lodging an investigation with the carrier.
  • Replacement products will be provided where a claim is approved or where required under Australian Consumer Law.
  • Additional shipping costs may apply for re-delivery due to incorrect address details or failed delivery attempts.

11. Privacy

  • We collect only the personal information necessary to manage bookings, communicate with clients, and fulfil orders.
  • This may include names, contact details, and transaction information.
  • Your information may be shared with trusted third-party providers such as payment processors and gallery delivery platforms solely for the purpose of delivering our services.
  • We take reasonable steps to protect your personal information and handle it in accordance with applicable privacy laws.

Legal & General

General liability limitations, future updates to the terms, and how clients can contact you.

12. Liability

  • To the extent permitted by law, the photographer’s liability for any claim arising out of or in connection with the provision of services or products is limited to the re-supply of services, replacement of goods, or a refund not exceeding the amount paid for the relevant service or product.
  • The photographer will not be liable for any indirect, incidental, or consequential loss, including but not limited to loss of income, loss of business, or loss of opportunity.
  • The photographer is not responsible for any failure or delay in performing obligations where such failure or delay is due to circumstances beyond reasonable control, including but not limited to weather conditions, venue restrictions, equipment failure, or third-party services.

13. Changes to These Terms

  • We reserve the right to update or modify these Terms at any time.
  • Any changes will be published on our website and reflected by the updated “Last Updated” date.
  • By continuing to use our services or website after any changes are published, you agree to be bound by the revised Terms.
